For all signatories, clear enforcement is important for the safety and health culture and a level-playing field. For a contractor who does not or no longer meets the requirements, this can lead to a notice of default and, in extreme cases, to rescission of the contract. The same applies tot private signatories. Although stopping the work because of one of the (sometimes many) contractors does not compl with ViA is not an obvious course of action. Here, too, the ultimate consequence is a cancellation of the contract and replacement by another qualified contractor.

Implementation

After earlier delay because of the corona crisis the Veiligheid in Aanbestedingen will be implemented on January 1st 2022. “For the past 2 years we have been communicating about the viA”, says GCVB chairman Koene Talsma. GCVB clients will use the Safety Culture Ladder in tenders and contracts as a selection criterion, award criterion or contract requirement.

  • Contract requirement: regarding a contract requirement the certification can be shown up to 90 days after the award.
  • Selection and award criterion: when it regards a selection or award criterion work is always given to a party that matches all criteria. All signatories, including clients, are certified or are going to get certified.
